Terms of Service
These terms govern your use of vivary.app and the Vivary iOS beta waitlist, operated by Vivary LLC ("Vivary," "we," "our," or "us"). By using the site or joining the waitlist, you agree to these terms. If you do not agree, please do not use the site.
1. The beta waitlist
Joining the waitlist lets us contact you about the Vivary iOS beta. It does not guarantee access: invites are limited and roll out in waves. We may change, pause, or end the beta program at any time. Beta access, when granted, is delivered through Apple TestFlight and subject to Apple's terms.
2. Acceptable use
- Provide an email address you own and are authorized to use.
- Do not submit the form using bots, scripts, or automated means, and do not attempt to disrupt, overload, or probe the site or its security.
- Do not scrape, copy, or reuse the site's content or design without permission.
3. Intellectual property
The Vivary name, logo, site design, copy, and imagery are owned by Vivary LLC or its licensors and are protected by intellectual-property laws. These terms grant you no rights to use them beyond viewing the site.
4. Beta and "as is" disclaimer
The site and the beta program are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or secure, that invites will be sent by any particular date, or that the beta will meet your expectations.
5. Limitation of liability
To the maximum extent permitted by law, Vivary LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site or the waitlist. Because the site and the waitlist are provided free of charge, our total liability for any claim will not exceed fifty U.S. dollars ($50).
6. Privacy
Your use of the site is also governed by our Privacy Policy, which explains how we handle your information.
7. Changes to these terms
We may update these terms from time to time. When we make significant changes, we will update the "Last updated" date above. Your continued use of the site after changes are posted means you accept the updated terms.
8. Governing law
These terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law principles. Any disputes arising from these terms or your use of the site will be resolved in the state or federal courts located in Colorado.
